Terms of sales

PREAMBLE :

"Pimp my lingerie !" is a company which number (SIRET) is 520 039 827 00032.

The website www.pimp-my-lingerie.fr is a e-commerce website offering for sale women lingerie goods, in rockabilly, vintage inspired, retro and pin-up styles.

These terms of sale list the rights and obligations of "Pimp my lingerie !" and the persons willing to complete a purchase on www.pimp-my-lingerie.fr, hereafter named "the Customer".

CLAUSE 1 - PRICING

Products's prices are given in euros (€) excluding parcel's preparation and shipping costs (see shipping).
VAT is never charged to the Customer (VAT-exempt, according to article 293 B of the French Tax Code).

All orders, whatever their origin, are payable in euros.

"Pimp my lingerie !" reserves the right to modify prices at anytime, but products will be billed on the effective price list at the time when the order was placed, subject to product's availability at this moment.

Title retention clause :  "Pimp my lingerie !" stays the owner of the products, until total collection by "Pimp my lingerie !" of the amount due by the Customer.

CLAUSE 2 - PAYMENT

Digital way payment :

"Pimp my lingerie !" offers "Paypal Business" payment solution, which securises every payment made in a digital way.
This system fights against impersonation, prevents fraud and securises the purchases.

Automatic recording systems are considered as prooves of the kind, the content, and the date of the order.

By digital ways, if the Customer has not paid for his order within 1 opened day by the moment it has been placed, the order is cancelled and the article(s) is/are put on sale again.

The order is shipped after the payment is received and validated by "Pimp my lingerie !".

Check payment :

Bank check are payable in EUROS ONLY and are payable to : "Pimp my lingerie !".

Please write your e-mail address behind the check and send it to : Pimp my lingerie ! - 48 avenue Jean Jaurès - 87600 Rochechouart - France.

Client has 5 opened days for the check to reach "Pimp my lingerie !". After this deadline, the order is cancelled and the article(s) is/are put on sale again.

The order is shipped after the payment is received and validated by "Pimp my lingerie !".

The Customer has 5 opened days to send his payment to "Pimp my lingerie !". After this deadline, the order is cancelled and the article(s) is/are put on sale again.

The order is shipped after the payment is received and validated by "Pimp my lingerie !".

In every instance, a confirmation e-mail is sent to the Customer to confirm his order.

"Pimp my lingerie !" reserves the right to suspend or cancel any order or shipping in case of payment authorization refusal by the asked financial institutions, functions of the payment method chosen by the Customer.

The information given by the Customer (name, address...), when the order is placed is commited to him : in case of error in the Customer's name and address wording, "Pimp my lingerie !" can't be held responsible if the order appears impossible to be delivered.


CLAUSE 3 - AVAILABILITY

Products and prices are available as long as they are visible on the website, while stocks last.

When an order is placed by the Customer, "Pimp my lingerie !" checks the product(s)'s availability.
If there is one or more unavailable product(s) after the order is placed, the Customer is informed by e-mail or telephone about the unavailable product(s).
In that case, "Pimp my lingerie !" commits to deliver the product(s) within 30 days after the order is placed, or to give a refund to the Customer (refund = price of the unavailable product(s) at the moment the order was placed).

If one of the produt is out of stock in an order, "Pimp my lingerie !" ships the rest of the order, with an informative message.

The order validation date corresponds to the payment date (for Paypal payment) or the check or bank transfer receipt.

CLAUSE 4 - DELIVERY

Order preparation cost :

The order preparation costs come to 1€ by order, no matter the order's weight or kind (except for free shipping for order of more than 60€ in France, 100€ for the rest of the world).
This amount is directly added to the following shipping costs.

Shipping costs:

Pimp my lingerie ! uses "La Poste" services (Colissimo, registered parcel) :

* R1 rate applies to less than 50€ orders.
R2 rate applies to orders between 50€ and 200€.
R3 rate applies to orders until 400€.

Shipping costs are automatically calculated and appear on the order form functions of the Customer's country, the order's weight and the purchase amount.
For shippings outside the European Union, possible taxes (VAT, customs...) could be billed to the Customer at the parcel's arrival, and are at the Customer own expenses.
"Pimp my lingerie !" cannot be held responsible if these taxes are not paid by the Customer.

Hard-to-access places :

"Pimp my lingerie !" cannot be responsible for shipping issues resulting from hard-to-access shipping address. These difficulties' consequences are the Customer's responsability.
"Pimp my lingerie !" cannot be sued if damages happen in this case.

Delivery lead time :

The order is prepared within 2 worked days, but it can be longer in high activity periods (Yule, sale...).

After order's confirmation and preparation, "Pimp-my lingerie !" commits to deliver to "La Poste", all the products ordered by the Customer. This carrier commits to deliver the order at the address given by the Customer and provided to "La Poste" by "Pimp my lingerie !".

Delivery lead time fully depends on "La Poste".
Colissimo's parcels are usually delivered within 2 worked up days in Mainland France. A deadline exceedance can't give rise to an order's cancel, a discount, or damages' payment, from the moment the Customer's parcel is delivered within 30 working days after the order's confirmation.

"Pimp my lingerie !" cannot be held responsible for loss or damages caused by "La Poste".

Order loss / robbery :

"Pimp my lingerie" offers two french shipping methods : "Colissimo suivi" (delivered WITHOUT signature) and "Colissimo recommandé" (signature required).

In case of non-received order, the Customer must inform "Pimp my lingerie". "Pimp my lingerie" starts from here a postal claim. This claim can take sometimes to be resolved, and determinate if the parcel is lost or delivered.

"Pimp my lingerie" can't be held responsible for lost orders.

To receive compensation in case of loss or robbery, the Customer must choose when ordering the "Colissimo recommandé" (WITH signature) shipping method.

Delivery tracking :

Your order could be tracked before its shipping on www.pimp-my-lingerie.fr website, then on "La Poste" website : www.colissimo.fr/particuliers if it is a tracked order.

CLAUSE 6 - SPONSORING

The sponsoring system created by "Pimp my lingerie !" is to gain customers' loyalty.

The sponsored has to write during his registering in the appropriate field, the EXACT e-mail of his sponsor (the e-mail has to be exactly the same one given to "Pimp my lingerie !" by the sponsor when he registered).

"Pimp my lingerie !" will check the information, then will give both to the sponsor AND the sponsored a 10€ voucher available for a 39€ purchase minimum. The voucher will be valid for one year from its creation. It will be ONLY sent by digital ways, within one week.
All year long, discounts will be send to the sponsors and sponsored.

This sponsoring system is only dedicated to "Pimp my lingerie !"'s customers. Participation to sponsoring is open to individual persons over 18 years. People working for "Pimp my lingerie !" are excluded.
Participation to sponsoring could be only done by digital ways on www.pimp-my-lingerie.fr.

The sponsor can sponsor any godchild he wants, but he can't sponsor for commercial purposes.
Sponsoring doesn't work with already clients' godchidren, or already sponsored by somebody else.
A person can be member of www.pimp-my-lingerie.fr only one time.
The voucher can never be refunded.
"Pimp my lingerie !" has the right to refuse a sponsoring that would'nt be conform to the tone of this article, and so, to cancel advantages and discounts linked with sponsoring.

Participation to sponsoring involves a without reserve acceptation of this whole clause.
"Pimp my lingerie !" can modify for any reason availability dates, vouchers' parameters, or advantages' kinds linked with sponsoring program, or delete it, at its discretion.
"Pimp my lingerie !" can stop or/and modify the settlement or/and the website at anytime during the sponsoring program without any notice or necessity to explain its decision, "Pimp my lingerie !" cannot be held responsible for that.
Any settlement's modification will be put online and will be immediately enforceable. Every sponsors and godchildren are due to accept it as soon as they agree to participate to the sponsoring program, as soon as the new settlement as been put into force.

CLAUSE 7 -  FULL SATISFACTION OR FULL REFUND

According to L.121-16 article from Code of Consumption of the French Republic, the Customer has a 7-day period of withdrawall (from the moment he has received his parcel) to ask the exchange or refund of his order to our Customer Service Department.

The product(s) must be returned to "Pimp my lingerie !" in its original state, in its original packaging, and not worn.
After these conditions checked, "Pimp my lingerie !" will exchange the product or refund the Customer. If the criteria are not met, no refund is callable. The Customer stays the product's owner, that he can take at "Pimp my lingerie !"'s address or by paying shipping costs again for a new shipping.
For the request to be dealed with faster, the Customer must enclose to the returning parcel a photocopy of his invoice, mentioning the article(s) whose refund or exchange is requested (and size if it applies).

In case of refund, this one will be made by the same payment method the Customer used when he ordered, in the same currency and the same rate of exchange.

In case of exchange, the product's return is at the Customer's expense.
The product(s) must be returned to "Pimp my lingerie !" in its original state, in its original packaging, and not worn. After these conditions checked, "Pimp my lingerie !" will exchange the product.
This one must send with the goods' return a 5,60€ fixed check for new chosen product's shipping costs.
The FIRST re-dispatching of the product(s) is at "Pimp my lingerie"'s expense.
For next re-dispatchings, a 5,60€ fixed check will be required from the Customer for EACH re-dispatching.

However, if the return is caused by a "Pimp my lingerie !"'s mistake, the shipping costs can be refunded. If so, the Customer must send with the return a postal receipt.

Clause 8 - RESPONSABILITY

"Pimp my lingerie !" cannot be held responsible for the contract's non-fulfilment in case of fortuitous situation, force majeure, disturbance, complete or partial strike especially of postal services or carriers and/or communication, flood or fire.

The Customer's choice and purchase of a product on "Pimp my lingerie !"'s website are placed under the Customer's responsability.

CLAUSE 9 - PRIVACY

"Pimp my lingerie !" commits not to disclose to a third party information given by the Customer. This is confidential. It will be internally used to process the Customer's order and to strengthen and customize communication and product's advertisement exclusively for "Pimp my lingerie !" Customers, especially by the newsletter offered by the website.

The Customer automatically suscribes to the newsletter when he registers on the website. However, the Customer can unsuscribe at any moment, by clicking on the "unsuscribe" link at the bottom of the newsletter, or by unsuscribing its e-mail address directly on "Pimp my lingerie !"'s website.

The website www.pimp-my-lingerie.fr is declared at CNIL (National Commission for Data Protection and Liberties) with number 1413378.

As a consequence, according to the French law on data-processing and liberties (loi informatique et libertés) of January, 6th 1978, the Customer has right to access, modify, rectify and delete the data that concern him.
For this, the Customer just need to ask online, indicating his first name, name, address and e-mail address :

ARTICLE 10 - Intellectual property

Every text, comment, work, illustration and image present in www.pimp-my-lingerie.fr website are reserved by a copyright and intellectual property, for the entire world. As such and and in accordance with Intellectual Property Code, the only authorized way to use this content is for a private use, subject to more restrictive conditions of Intellectual Property Code. Any other use is a counterfeit's constituent and is punished by way of Intellectual Property Code except with a prior  "Pimp my lingerie !"'s authorization. All rights are reserved.

CLAUSE 11 - DISPUTES

Every dispute's settlement could be done with our Customer Service Department and, failing amicable resolution, it will be the responsability of the Lyon's Commercial Court.

Moreover, "Pimp my lingerie !" reserves the right to proceed the Customer in front of his local court.

CLAUSE 12 - Customer's commitment

According to March, 13th 2000 Fench law about digital signature, as soon as a Customer's order is validated by a click, the Customer is accepting its content and the "Pimp my lingerie !"'s terms of sale.

These hereby terms of sale are governed by French law and can be modified at anytime without any further notice.
